Welcome to the Fashion Addict website (“Website”).

Before using the Website please read these Commercial Terms and Conditions (“Terms and Conditions”) carefully. The Terms and conditions govern your access to the Website, its use and all legal relations between Sportin s.r.o. and you. These Terms and Conditions apply to orders in the online shop at www.fashion-addict.eu. The operator of the Fashion Addict online shop is Sportfin s.r.o., with registered office at Buková 8, 81102 Bratislava, Slovakia, company registration number (IČO): 35887745, VAT number (IČ DPH):  SK2021844528. The company is registered in the business register managed by the District court Bratislava I., section s.r.o., insert number 31924/B and has a bank account number 178923208 bank code 0900.

Should you not agree with these Terms and Conditions, do not visit or use the Website. Accessing or using the Website constitutes that you agree with these Terms and Conditions. All legal relations concerning the online shop www.fashion-addict.eu are governed by Civil Code, Act no. 40/1964 Coll. and  Act no. 250/2007 Coll. on Consumer protection.

 1. CONDITIONS OF USING THE WEBSITE

 1.1 Access

Access to the Website is granted only in compliance with these Terms and Conditions.

1.2 Rights of Fashion Addict

Fashion Addict reserves the right to:
(i) a temporary or permanent change or cancellation of the Website (or any of its parts) without standing liable to third parties in connection with any changes or cancellation of the Website;
(ii) change the Terms and Conditions (or any of their parts);

(iii) withdraw from the Order or Contract, should Fashion Addict have a reasonable suspicion that the buyer acts contrary to good manners in the mutual relations. For example, repeated non-acceptance of goods at an agreed time constitutes acting contrary to good manners.

1.3 Declaration of non-liability

Fashion Addict shall by no means be liable for loss, damage or any costs or outlays (lost profit included) caused, directly or indirectly, by any failure or delay in fulfilling of obligations arising from the Contract due to any event or circumstances beyond control of Fashion Addict, including but not limited to strikes, power failure,  breakdown or vis major.

2. PROTECTION OF PERSONAL DETAILS

2.1 Gathering of personal data

Fashion Addict processes the personal data of buyers which was given to Fashion Addict in order to provide their services. Personal data is gathered through the website http://www.fashion-addict.eu.  This personal data includes the personal data given at registration and purchase, namely the first name and surname, e-mail address, invoicing address,  delivery address and the phone number. By registering with the Website, the buyer agrees with gathering and processing of their personal data in the database of Fashion Addict. Fashion Addict gathers personal data for the purpose of: (i) fulfilment  of contract to which the data subject is a party, (ii) protection of rights and legally protected interest of Fashion Addict and data subject, (iii) providing goods or services to data subject, (iv) internal marketing analyses and statistic research  for internal purposes of Fashion Addict. Personal data is accessible exclusively to employees of Fashion Addict. For the purposes of delivery of orders from Fashion Addict, i.e. for the purposes of fulfilment of the contract, the personal data will also be shared with DPD Direct Parcel Distribution or another delivery company. Providing personal data is voluntary; the use of services of Fashion Addict, however, is impossible without providing personal data. User acknowledges that the Website is monitored and may record information about their visit to the Website.

 3. GENERAL PURCHASING CONDITIONS

 3.1 Conditions of purchase

The buyer acknowledges that the Contract for purchase of goods is governed by the Terms and Conditions, mainly the provisions of article 3.

3.2 Price of goods   

The buyer can verify  the price of goods under particular items listed on the website of the seller www.fashion-addict.eu.  The purchase price stated includes VAT. Prior to despatching the goods, the full price including shipping and packaging will be calculated and the buyer will be asked to confirm it. The buyer is obligated to pay the purchase price valid at the time when the order is placed and in accordance with point 3.2 of the Terms and Conditions. The payment for the ordered goods (as listed in the order and accepted by the Seller) shall be made duly and in time. The purchase price is covered by the Buyer according to the selected method of payment upon ordering. The purchase price according to point 3.2 of the Terms and Conditions does not include the shipping costs of purchased goods. The information about the shipping price is stated in article 3.5  Delivery of the goods of the Terms and Conditions. The costs of using electronic means are governed by the agreement between the Buyer and their internet provider or their provider of electronic communication services. If the Buyer makes an advance payment of purchase price and the Seller is not able to arrange the delivery of the goods, the Seller shall return the paid purchase price to the Buyer within 15 days after receiving a notification of the Buyer’s decision; the purchase price shall be returned to the account of the Buyer, the number of which shall be sent by e-mail to info@fashion-addict.eu.

3.3 Payment terms

The payment can be made by the following means:

The ordered goods are to be paid for within 3 working days of delivery, the variable symbol being identical to the order number ID, which the Buyer shall receive in the confirmation e-mail.  Should the Buyer not make the payment within 7 days, the Seller has the right to cancel the order automatically.

The invoice  with the purchase price issued by the Seller, which will be sent to the Buyer along with the goods, serves as a tax document and delivery note. If Fashion Addict cancels the order of goods after the purchase price has been paid, Fashion Addict shall refund the paid amount to the Buyer in full.

3.4 Order of Goods and closing the Contract of Purchase

The order is a behest from the buyer to the seller to carry out the sale and delivery. All orders placed by the means of the internet webpage www.fashion-addict.eu have a binding effect. To place an Order of Goods it is necessary to fill out the order form with the contact details of the buyer. The buyer shall place the order by putting the selected goods into the shopping cart. In the shopping cart, the buyer can edit the required number of selected Goods. The Buyer will be taken through a simple process at the end of which they will confirm the Order of Goods. The Buyer shall receive an automatically generated informative acceptance of Order of Goods by Fashion Addict. The Buyer can cancel the Order of Goods by e-mail at info@fashion-addict.eu (in which case the Buyer shall receive an order cancellation  confirmation) or by phone at the telephone number: +421 949617160.  Upon sending a binding confirmation of order, the Buyer shall immediately get an acceptance of order to the e-mail address stated in the order form. Any further information concerning the order shall be sent to the mentioned address. The purchase contract between the seller and buyer is established upon sending the order by the Buyer and receiving the order by the Seller.

3.5 Delivery of goods and delivery time

The place of delivery of Goods is the delivery address stated by the Buyer in the Order of Goods. The Goods shall be deemed delivered upon delivering to this address.

All orders, are shipped via DPD or SP and will require a signature upon delivery of all goods shipped. Each purchase is insured by us during it’s time in transit, until it is delivered to you. You can track your parcel by emailing us your order number and we can track it for you or email you a tracking number that you can use to track your parcel on the DPD website: www.dpd.com or SP website: www.posta.sk/en
Most orders will be dispatched within 2 working days subject to credit clearance, address verification and availability of items.
If the Buyer opted for a different method of payment than cash on delivery, e.g. bank transfer, the delivery time starts by full payment of the purchase price, i.e. upon crediting the full purchase price to the account of the Seller.

In the event that we cannot deliver to you within the time specified when placing your order, or an item is out of stock, we will let you know and try to resolve the problem as quickly as possible. All new orders are taken as separate and are therefore treated individually.

If it is not possible to supply the goods in the stated period, the Seller shall inform the Buyer about this fact without any delay as well as provide the information about the alternative delivery time, or alternatively, the Seller shall offer another product comparable to the original one (alternative performance). In this case, the Seller must ask for a consent of the Buyer. Should the Seller not be able to supply the goods and the Buyer and the Seller have not agreed on an alternative performance, the Seller is obligated to refund the paid purchase price to the Buyer within 15 days after the delivery time has expired.

DUTY & TAXES
Please note that any duty and taxes incurred in the country of destination are the sole responsibility of the customer.
NOTIFICATION OF SHIPPING
Once we have dispatched your order, we will send you an email notifying you of this. This will be our acceptance of your order and this completes the contract between you and us. This will apply regardless of whether, for reasons out of our control, you have not received that email. If we have informed you that your order hasn’t been accepted or if you have cancelled your order in accordance with the returns policy, we will not dispatch your goods.
We aim to deliver your chosen items to the place and person of your choice, in perfect condition and in the shortest time possible.

If you refuse a shipment from Fashion Addict, you are responsible for the original shipping charges, any Import Fees that are incurred on the package, and the cost of returning the package to Fashion Addict. This amount will be deducted from your merchandise refund. 

3.6 Withdrawal from Contract for purchase of goods

1) Fashion Addict reserves the right to withdraw from the Contract for purchase of goods if :
(i) it is not possible to gain authorization for the payment of buyer( if the method of payment by card has been selected)

2) The buyer can withdraw from the Contract for purchase of Goods  within 14 days of accepting the Goods. Should the Buyer decide to withdraw within this period, they are obligated to observe the following terms:

(i) Receipt of e-mail at info@fashion-addict.eu or a phone call stating the number of the Order of Goods and the account number to which the money is to be refunded, as well as a clear and lucid notification of withdrawal from the particular Contract for purchase of Goods;

(ii) the Goods must be in the original packaging, it cannot show signs of use, it must be undamaged, complete (including all accessories, warranty card, manual etc.) along with the original proof of purchase.

After fulfilment of these conditions, the purchase price shall be refunded to the Buyer.

A withdrawal from the Contract for purchase of Goods shall be deemed invalid if the period of maximum 14 days after accepting the performance has expired. Should the Goods be damaged, incomplete or  showing any other defects, Fashion Addict has the right to claim compensation for the decrease in the value of returned Goods. If the abovementioned conditions  are met, the payment for Goods shall be refunded by bank transfer to the account number given by the Buyer within 15 days of delivering the withdrawal from Contract for purchase of Goods. Should one of the abovementioned conditions not be met, as a result of which the provable delivery of Withdrawal from Contract for purchase of Goods within the stated period will not take place, the acceptance of Contract for purchase of Goods shall not be possible and the Goods shall be returned to the sender at their expense.

The Seller reserves the right to cancel the order if it is not possible to  supply the Goods to the Buyer:

(i) within the period given by these Terms and Conditions for the reason of insufficient stock or unavailability of Goods.

(ii) at a price stated in the online shop, unless an agreement on alternative performance is made with the Buyer

(iii) because it is impossible to confirm the order for various reasons (wrong telephone number, number not available, the Buyer does not reply to e-mail etc.)

(iv)  the Goods are not produced or supplied any more

Should such a situation occur, the Seller shall contact the Buyer in order to decide on the course of action. The Buyer shall be informed about the cancellation of the order by e-mail of telephone.

3.7 Liability for defects

All marketed goods are under 24-month warranty given by law in accordance with the amendment of the Civil Code no. 150/2004. The warranty begins to run on the day of accepting the Goods by the Buyer, unless otherwise stated. In the case of extended (contractual) warranty, Fashion Addict will state the conditions and extent of the extended warranty in the warranty card. Warranty does not cover normal wear and tear of the Goods (or any of their parts) caused by common use. Shorter life of the Goods connected to the mentioned wear and tear cannot be deemed as a defect, and so shall it be considered by a potential claim. Should the Goods not be provided with a warranty card, the tax document shall substitute it for this purpose.

The Buyer has the following rights when claiming liability for defects:

(i) if the defect is eliminable, the Buyer has a right to a free, appropriate and timely elimination of the defect; the Buyer has a right to an exchange of defect goods unless it is disproportionate considering the nature of the defect. Should this procedure not be  practicable, the Buyer has the right to a proportionate  discount from the Purchase price of the Goods or the right to withdraw from the Contract for the purchase of Goods.
(ii) if the defect is inherent and it hinders the proper use of the Goods, the Buyer has the right to an exchange of the Goods or to withdraw from the Contract for the purchase of Goods;
(iii) if the defects are eliminable and occurring  repeatedly or in higher numbers and they hinder normal use of the Goods, the Buyer has the right to an exchange of the Goods, or to withdraw from the Contract for the purchase of Goods;
(iv) if the defect is inherent and the Buyer does not claim an exchange of the Goods, they have the right to a proportionate discount off the Purchase price, or the right to withdraw from the Contract for the purchase of Goods. Should the Buyer discover any inherent defects on the purchased goods during the warranty period, not caused by their use, they have the right to file a complaint about the Goods. The buyer can file a complaint in any of the following ways:

 (i) at the e-mail address of the provider: info@fashion-addict.eu,
(ii) by telephone at the telephone number: +421 94961716,

Subsequently, the Buyer will send or deliver the returned Goods to Fashion Addict along with the description of the defect, copy of the receipt and, if possible, in the original or any other appropriate packaging. The complaint will be handled without any undue delay, no later than 30 days after the complaint has been filed, unless Fashion Addict makes a different arrangement with the Buyer. Should the period for handling  the complaint not be kept, the Buyer has the right to an exchange of Goods if available, or the right to withdraw from the Contract for purchase of Goods. In case of a justified complaint, the Buyer is entitled to a compensation for expenses connected to the complaint. In case of an unjustified complaint, Fashion Addict is obligated to issue a written substantiation of the dismissal of the complaint; in this case the Buyer and Fashion Addict are not entitled to a compensation of their expenses connected to the complaint.

3.8 RETURN POLICY

  1. Merchandise must be returned within 15 days.
  2. Merchandise must not be worn, altered, or washed.
  3. Merchandise must have all tags attached and be returned in original packaging.
  4. Some items from FASHION ADDICT ship with an attached security tag.
  5. Merchandise returned without the original security tag, or a damaged security tag, may result in a delayed refund or may not qualify for a refund.
  6. Footwear must include the original shoe box in its original condition, without postal labels. Shoe box fees are charged when footwear is returned in a damaged shoe box, or without the original shoe box.
  7. Please Note:

Shipping and handling charges are not refundable. Packages that arrive  COD may be denied, or the COD amount may be deducted from your return.  Final Sale items may not be returned.

INTERNATIONAL RETURNS

  1. Complete the return form included in your order and securely repackage your merchandise. Cover or remove any original mailing address label or carrier barcodes from package.
  2. NOTE:  When returning footwear, do not use your shoe box as your shipping box.
  3. Place the return form from your original invoice on the outside of your package, along with your customs document, to expedite delivery.
  4. Please send your return to:

  5. Ship your package using a trackable, insured shipping method. FASHION ADDICT cannot accept responsibility for packages we do not ship. Please keep the tracking details for your records.

You will receive an email once your return has been processed. Please allow 5 business days from the time we receive your return for it to be processed.

Refunds and processing time: If your package arrives at FASHION ADDICT within the 15-day timeline specified above, your refund will be processed in the original form of payment within 5 business days. You will be notified via email to the address listed on your account when this transaction has taken place. Your banking institution may require additional days to process and post this transaction to your account once they have received the information from FASHION ADDICT.

4. FINAL PROVISIONS

 The Terms and Conditions are binding from the day of publication on the Seller’s website andthey are in effect to the extent and in the wording as stated on the website of the Seller on the day the Buyer places the order. By sending the order to the Seller, the Buyer confirms they accept the price of ordered goods including potential dispatching and shipping costs and the Terms and Conditions as amended at the moment of sending the order.

The Seller is bound by their offer of goods, including the price, from the moment of sending the acceptance to the Buyer to the moment of delivering the goods to the Buyer, unless any provisions of the Terms and Conditions state otherwise.

The Buyer is bound by the sent order until the date scheduled for the delivery of the Goods. The purchase contract in accordance with the Terms and Conditions can be closed in Slovak language and the Seller reserves the right to amend the wording of the Terms and Conditions.
